DATA PROTECTION

Law no. 190 FROM 18 July 2018 is the rule that transposes the General Data Protection Regulation into Romanian domestic law (GDPR) of the European Union (Regulation (UE) 2016/679), establishing the necessary measures for its effective application in the country, targeting any entity, be it public or private. Among other things, it regulates the obligations and responsibilities of operators and persons authorized by operators with regard to the processing of personal data, as well as the additional requirements for the processing of special categories of data (for example, national identification numbers or biometric and health data), designation of the DPO and the regime of applicable sanctions.

Equality plans and the prevention of harassment

In Romania, legislation promoting equal opportunities and preventing harassment focuses on ensuring a safe and non-discriminatory working environment, in accordance with EU principles, which were manifested through legislative acts such as Law no. 202 FROM 19 April 2002 regarding equal opportunities and treatment between women and men and Government Ordinance no. 137 FROM 31 august 2000 on the prevention and sanctioning of all forms of discrimination, including, in turn, the current National Strategy of 19 December 2022, which aims to promote equal opportunities and treatment between women and men. Thus, within the mentioned norms, obligations are established for employers to prevent any form of harassment - be it sexual, psychological or gender reasons, race, disability or other protected characteristics – and to guarantee equality of treatment and opportunity for all workers. Also, requires the creation of internal reporting procedures, investigation and resolution of conflicts, as well as promoting awareness and training policies to prevent discriminatory behaviors in the workplace, among others.

The reporting channel, also known as the Reporting Channel, is the mechanism that entities make available so that employees or third parties can report possible violations of the rules, irregularities or improper acts. In Romania, these systems are not just a recommendation, but an obligation provided by Law no. 361 FROM 16 December 2022, being mandatory for businesses with 50 or more employees and for other entities obliged by the nature of their activity or structure.

Prevention of money laundering

In Romania, the obligation to prevent money laundering is established as an essential regulatory framework to guarantee the integrity of the financial system and the transparency of economic transactions. Financial institutions, as well as certain professionals and entities subject to supervision, are required to implement internal customer identification procedures, monitoring suspicious operations and reporting unusual activities to the appropriate authorities. These measures, aligned with European Union directives and national legislation, in particular Law no. 129 FROM 11 July 2019, it aims not only at the detection and prevention of money laundering, but also strengthening confidence in markets and protecting the economy against illicit activities. Also, compliance with these obligations is supervised by the National Office for the Prevention and Combating of Money Laundering (ONPCSB) from Romania, which oversees the effective application of controls and sanctions violations in accordance with the law.

In Romania, there is no exception applicable to legal entities regarding the possible criminal liability that they can assume. However, they can be active subjects and declared guilty of all the crimes provided for in the Romanian Criminal Code.
